This contractual document will govern the General Conditions for contracting products or services (hereinafter, «Conditions») through the website abeñula.com, owned by Laboratorios Nicolich S.L., hereinafter, PROVIDER, whose contact details also appear in the Legal Notice of this Website.

The purpose of this contract is to regulate the contractual trade relationship between the PROVIDER and the USER, which arises when the USER accepts by ticking the corresponding box during the online contracting process. The contractual trade relationship involves the delivery of a specific product or service, in exchange for a certain price which is publicly displayed on the website. Please, read all terms and conditions carefully.

PRODUCTS

All products available on this website have our laboratories’ guarantee. The brand “Abéñula” is registered and protected by copyright since 1927.

PRICES

Prices displayed on the website are valid for Spain and Europe. These prices, unless expressly stated otherwise, do not include shipping, handling, packaging, insurance or any other additional services and attachments to the product or service purchased. All prices are valid except for typing mistake. All sales are made with its corresponding order receipt. All products are available for sale.

All sales will be considered as if they have being done in Málaga in legal terms. The prices indicated for each product include Value Added Tax (VAT), so-called IVA in Spanish, or any other applicable taxes.

SHIPPING

Shipping costs

  • Within the Spanish peninsula, all shipping costs are free for order higher than 30€, for orders lower than 30€ the shipping cost will be 3,99€.
  • For Ceuta, Melilla or Balearic Islands, shipping will be made through Correos (national mail company), and they will cost 6,90€ (by certified mail).
  • For Canary Islands, shipping will be made through Correos (national mail company). The shipping has a 12€ handling fee plus 6,90€ of basic shipping cost (18,90€ in total).
  • Europe: All orders will be shipped by Correos (national mail company) for 15€, including handling fee and shipping costs.
  • OTHER DESTINATIONS: please consult.

DELIVERY TIMES

All deliveries will be sent from Spain by transport within 48-72 inside the country, except weekends and festive holidays.
All orders with its details fully complete, will be sent the same day, as long as they are made before 12 AM (Spain time zone). If the order has been made after 12 PM, the shipment will be made on the next working day.
If the shipping terms should vary, the USER will be informed by email.
For Balearic Island, Canary Islands, Ceuta and Melilla the shipping time may be longer, as well as for the rest of Europe.

CUSTOMS

Shipping for countries OUTSIDE the European Union and other special areas (example: Canary Islands) may have an extra fee for customs cost and import taxes (customs duty) that will be charge by the destination authorities. Additional customs costs will be paid by the USER, because the PROVIDER has no control over those quantities and cannot anticipate them. These costs are changeable and depends on every customs office and country. For more information please contact your customs office.

PAYMENT METHODS

  • Credit card. Payment by credit card will be made through a secure payment procedure by CAJAMAR bank and their safety server. Under NO circumstances the PROVIDER will keep any of your credit card details on its files. That data is always processed by the bank only.
  • Paypal. Payment will be made through Paypal’s international payment system. This payment method has a commission fee of +4%. For more information, please check www.paypal.es
  • Bank transfer, on the account number :3058-0854-85-2720015897 – or IBAN: ES7830580854852720015897 on the name of “Laboratorios Nicolich, S.L.”. You must indicate yourname and order number on the details of the bank transfer.

REFUNDS

The USER has 7 working days counting from the day of the order reception to return the products (according to the Spanish General Law for the Defence of Consumers and Users, article 44 Spanish law 7/1996 of January 15th, modified by the Spanish law 47/2002 of December 19th). No returns would be accepted if it has not been previously approved by the PROVIDER (Laboratorios Nicolich, S.L.)

In order to do that, the USER must contact the PROVIDER customer service by email on the following address: nicolich@nicolich.com. The shipping costs for the return will be paid by the USER. Under no circumstances the PROVIDER will accept any return if the shipping costs are pending payment. The refund will be made only once the products are back at the PROVIDER storehouse.
Once the PROVIDER has verified the product are on perfect conditions (they have not being used, and they are on their original boxes and packaging), the refund will be make (return shipping costs not included) by the same payment method the USER chose on its original order.

Garantee
All products have the manufacturer guarantee against manufacturing defects. On all “Abéñula” products there is an alphanumeric code on the side of the box, which will be the identifier for the date of manufacturing. The products do not have an expiration date, so they can be used on good conditions, as long as five years.
Each manufactured batch has pass the innocuousness test, and have been ophthalmologically tested.

Confidentiality
According to the provisions of Regulation (EU) 2016/679 of 27 April (GDPR) and the Organic Law 3/2018 of 5 December (LOPDGDD)., the USER data provide on forms will be added and treated on the files owned by Laboratorios Nicolich, S. L. in order to complete the USER order, and to inform him/her about promotions and offers related to our services and products. Any other use of the USER personal data not metion on the above paragraph will need the previous and express consent of the USER.
The rights of the USER are: Right to withdraw consent at any time. Right of access, rectification, portability and erasure of your data and the limitation or objection to their processing. The right to file a claim with the Spanish Supervisory Authority (www.aepd.es) if you consider that the processing does not comply with the current legislation.
